WORKSHOP TERMS AND CONDITIONS


1. Post-Repair Inspection Requirements

• Certain repairs and installations require a complimentary post-repair inspection.

• Unless otherwise advised, this inspection must be completed within 14 days or 500 kilometres of the work being completed, whichever occurs first.

  • The customer is responsible for arranging this inspection appointment.

  • Failure to present the vehicle for the required inspection may affect eligibility for warranty claims where the inspection would reasonably have identified adjustment, wear, loosening, settling, or developing issues.

 

2. Warranty Coverage

• Warranty applies only to parts supplied and workmanship performed by Spencer's Truck, Bus & Caravan Services.

  • Warranty claims must be reported as soon as reasonably practicable after becoming apparent.

  • The customer must cease using the vehicle where continued operation may cause further damage or create a safety risk.

  • Replacement of a component under warranty does not restart or extend the original warranty period unless expressly stated in writing.

  • Warranty does not apply to damage arising from misuse, overloading, racing, competition use, accidents, off-road use beyond manufacturer specifications, lack of maintenance, modification by third parties, or normal wear and tear.


3. Third Party Repairs

• Spencer's must be provided a reasonable opportunity to inspect and rectify any alleged defect prior to repairs being undertaken by a third party.

  • Spencer's will not be responsible for costs incurred through third-party repairs unless prior written approval has been provided by Spencer's.

  • Spencer's reserves the right to inspect and retain any replaced components relating to a warranty claim.

  

4. Manufacturer Supplied Components

  • Parts supplied by Spencer's may be subject to manufacturer warranty conditions.

• Manufacturer warranty claims are subject to assessment and approval by the manufacturer or supplier where applicable.

  • Spencer's will assist customers in facilitating legitimate manufacturer warranty claims.

 

5. Vehicle Collection and Storage

• Vehicles should be collected promptly following notification that works are complete.

  • Storage fees of $20 per day may apply to vehicles remaining on site more than 7 days after completion notification unless alternative arrangements have been agreed in writing.

  • Storage charges must be paid prior to release of the vehicle.

 

6. Payment Terms

  • Payment is due immediately upon completion of works unless otherwise agreed in writing.

  • Spencer's reserves the right to retain possession of the vehicle until payment has been received in full.

  • Interest and recovery costs associated with overdue accounts may be charged where permitted by law.


7. Customer Supplied Parts

• No warranty is provided on customer supplied parts.

  • Labour associated with fitting customer supplied parts is warranted only in relation to workmanship and installation.

  • Spencer's accepts no responsibility for delays, failures, or compatibility issues associated with customer supplied components.

 

8. Diagnostic Work

• Diagnostic time and fault-finding services are chargeable regardless of whether repairs proceed.

  • Additional faults discovered during diagnosis or repair may require further authorisation before work proceeds.

 

 9. Limitation of Liability

• Customers are responsible for removing valuables and personal belongings from vehicles.

  • Spencer's accepts no responsibility for loss or damage to personal items left in vehicles.

  • To the extent permitted by law, Spencer's liability is limited to repair, replacement, or reimbursement of the original service supplied.

 

10. Abandoned Vehicles

• Vehicles remaining uncollected for more than 90 days after completion notification may be treated as abandoned in accordance with applicable legislation.

  • Spencer's reserves all rights available under applicable legislation in relation to abandoned vehicles, including recovery of unpaid charges, storage costs and disposal costs.

 

 11. Authority to Carry Out Work

  • The person delivering the vehicle warrants they are authorised by the owner to request and approve repairs.

  • Authority to commence works may be provided verbally, electronically or in writing.

  • Collection of the vehicle or payment of the invoice constitutes acceptance of these terms and conditions.


12. Consumer Rights

• Nothing in these terms excludes, restricts or modifies any rights or remedies available to consumers under Australian Consumer Law.
